View Full Version : What's the deal on it now being illegal to homeschool in California unless you are a certified teacher?

I just received a letter in the mail asking for money to support (with a one time, tax-deductible donation of $25 or more) the legal fight against the state of California on this matter.

Pro-bono counsel for several of our statewide inclusive homeschooling groups will be seeking permission to file amicus briefs regarding the case with the hope that the courts will have a better understanding of the laws we use to homeschool (homeschooling itself is rather alegal in CA with several ways to work around the compulsory attendance laws).
The way many of us in CA homeschool through the Private School Affidavit (R-4) was never actually threatened by this ruling because we were considered private schools by the state and the law does not require private schools to hire only certified/credentialed teachers (which is a very vague description anyway.) This really affected the Independent Study Programs put on by both private and public schools in the state with it's narrow interpretation of the compulsory attendance laws.
However, the ruling has no legal effect at all now that the courts will be rehearing the case, so we can continue on as usual.
We do have a resolution working its way through our Assembly in support of homeschooling that we are trying to get full bipartisan support for. This is more for our peace of mind in knowing who will be on our side if push comes to shove in creating tighter legislation.
